5 Things your Attorney won’t mention when hiring them!

Did you know that you may be better off without an attorney?

A lot of the time the things you are paying a hired attorney for almost any competent human could do themselves. All it takes is a little time and the drive to learn how.  With sites like www.nolo.com representing yourself is getting easier and easier.

Is your cause one that will generate little revenue?

Don’t expect an attorney to jump on your claim even if it is straight forward and solid when it comes to a wrong committed.  Few attorneys have a large scope of practice and most specialize in one field. If you claim is under 50 k chances are they won’t touch it. Remember smaller cases have fee’s associated with them which is just another reason to educate for self-litigation when dealing with these matters.

Have you ever won a case with a hired attorney before?

Just because the attorney has tons of experience in that field of expertise doesn’t mean that there a winner or a loser. Do your research and find out how many cases they have actually won. Have they ever been taken to trial etc. IF there’s at least one case that’s similar to yours in the win section you may be in good hands. Most attorneys tell here clients that they usually settle. This can be extremely bad! If your attorney isn’t willing to go to bat in court for you he most likely doesn’t have your best interest at heart. If self-litigation isn’t right for you education on the civil system is still a must even if you are using an attorney.

Has your attorney made some mistakes but you still can’t find anything listed on them that’s bad?

Whether an attorney is a bad apple or not may not be that simple to research as you thought. The ABA keeps a database of known ethics violators. You can find this information by calling 312-988-5321. The downfall is that it relies on voluntary reports from state bar counsels. This can be a dead end unless the lawyer has been suspended or disbarred. Many states just say he's "in good standing" even if he has had lots of complaints or worse.

Has your attorney ever seemed to look at you in ways they shouldn’t have or mentioned in a nonchalant way for a possible sexual relationship?

Other specialty’s like doctors and the like can be disbarred for such things but not attorneys! 20% of lawyers surveyed across the uSA by University of Memphis in 1993 stated they had or knew someone in their profession who had a relationship or affair with a client. Do you really want to have to worry about getting hit on by someone when dealing with such sensitive and important issues like a civil case? Most likely not.

""I have yet to see a death case among the dozens coming to the Supreme Court on eve-of-execution stay applications in which the defendant was well represented at trial?People who are well represented at trial do not get the death penalty.""

 - Supreme Court Justice Ruth Bader Ginsburg, April 9, 2001
